Everything you need to know about how Parkd operates, protects your data, and defines our relationship with the institutions and individuals we serve.
Terms of Service
Effective January 1, 2026 · Version 1.1
Overview
These Terms of Service govern your access to and use of the Parkd platform, including our web dashboard, APIs, mobile interfaces, and related integrations, provided by Parkd, Inc., a Delaware corporation.
By accessing or using any part of the Parkd platform, you agree to be bound by these Terms. If you are accepting on behalf of an institution, you represent that you have authority to bind that institution.
Who These Terms Apply To
Parkd serves two distinct parties:
- Institutional Customers: Schools, universities, municipalities, or organizations that have signed a Master Service Agreement (MSA) with Parkd. Where a signed MSA conflicts with these Terms, the MSA controls.
- Authorized Users: Individuals who access the platform under an Institutional Customer's account.
The Platform Is a Tool: Not an Enforcer
Parkd provides technology that surfaces license plate recognition (LPR) data and permit validation results. Parkd does not make enforcement decisions. All citations, towing authorizations, gate restrictions, and related actions are made solely by the Institutional Customer and its authorized personnel.
LPR confidence scores are informational only. Human review is required before any enforcement action is taken.
Permitted Use
The platform may only be used for on-site parking permit validation and enforcement on premises the Institutional Customer is authorized to manage. It may not be used for law enforcement referrals, immigration enforcement, individual tracking, or any purpose unrelated to campus parking administration.
Your Responsibilities
Institutional Customers are responsible for: posting adequate notice to their campus community that license plates are captured for parking enforcement; complying with all applicable surveillance and privacy disclosure laws; maintaining the security of administrator credentials; and executing a Data Processing Agreement (DPA) with Parkd before go-live.
Limitation of Liability
To the maximum extent permitted by law, Parkd's total liability is capped at fees paid in the prior 12 months. Parkd is not liable for indirect, consequential, incidental, or punitive damages. Parkd bears no liability for enforcement actions taken by Institutional Customers.
Governing Law
These Terms are governed by the laws of the State of California. Disputes are resolved by binding arbitration administered by JAMS in Santa Clara County, California. Class action claims are waived.
